A tip uncovers a large cartel of the parcel companies

The CNMC (National Market and Competition Commission) has sanctioned ten courier and parcel companies, including emails, for creating a large cartel to share business customers. The sanctioned companies had agreed not to contract with customers of ir business partners, Repartiéndoselos each or. The fine imposed amounts to 68 million, of which 19.6 correspond to state company. Competition has known information through a tip.

The investigation of CNMC has shown that, within framework of se agreements, some companies concluded in parallel verbal pacts of "non-aggression". Through se agreements companies involved in commercial relationship were committed not to make commercial offers to any of clients of ir competitor.

In this way, clients of both companies were prevented from accessing services of a part of competition. In total, nine cartels have been discovered. The companies Express with Cuatro, MBE with four and ICS with three, are those that have participated in a greater number of se agreements, thus depriving all its clients of receiving offers of several operators of couriers and parcels in Spain.

Accredited conduct is a very serious infringement of article 1 of Law 15/2007, and Article 101 of European Union's operating treaty with a variable duration (from ten years most lasting up to a year least).

The facts were investigated following a request for exemption from payment of fine of General logistics Spain, SL ("GLS") that led to completion of four CNMC inspections at post offices of Express, MBE, REDYSER and ICS, with which thousands of Corre were collected Electronic and WHATSAPP accreditation of sanctioned behaviors.

Sanctioned companies

Among sanctioned companies are state, post office, with a total of 19.6 million euros; UPS, with 19.2 million; TNT with 16.2 million; DHL with 5 million euros; Tourline with 3.1 million; Redyser with 2.1; Fedex with 1.8 million euros; ICS with 773,314 euros and MBE with 690,400 euros.
