The Minister of Finance, María Jesús Montero, has assured this Friday that government will not publish name of taxpayers who were accepted to tax amnesty of 2012, since law does not permit to apply retroactively a tax-type modification. This decision is controversial because president of government, Pedro Sanchez, said a couple of years ago that would publish list list when he arrived at Moncloa.More information

Montero explained that government "has studied this possibility" and concluded that, by amending law, it could be done in face of future fiscal amnesties--it made clear that executive has no intention of approving any new amnesty--, but "re is no capacity Legal "to do so with past amnesties.
The tax amnesty was one of most controversial measures of former executive of Mariano Rajoy. In 2012, PP approved a tax amnesty in order to enter some 2.5 billion euros. Spain was going through worst moment of crisis and financial markets launched unseen against sovereign debt. Rajoy's executive debated about asking for ransom. The special tax return (DTE), as y baptized Eufemisticamente to amnesty, allowed to legalize black money, much hidden in or countries, in exchange for paying only 10%.A failure despite incentives
During process doubts arose about guarantee that fraudsters would have to not be pursued and Treasury issued a dictate guaranteeing immunity if welcomed to voluntary regularization. In addition, it limited payment of tribute to last four years not prescribed. These provoked that, for example, paying only 3% could whiten all money that a evader had in Switzerland.
Although 31,500 declarations were presented of model 750, which served to regulate amnesty, only 1.2 billion, half of what was envisaged, was entered. The former Minister of Finance, Cristóbal Montoro, ended up apologizing repeatedly in Congress for approving measure. And although he claimed that it served to know many tax data of taxpayers at high risk of defrauding he recognized that it was a mistake.
Finally, Constitutional Court declared null and void fiscal amnesty last year. The judgement considered that Decree law approving tax pardon was unconstitutional because it was not right vehicle to pass this measure, which legitimized fraud."We will publish it," said Sánchez
"You Mr. Rajoy has again banned publication of tax amnesty of fraudsters who approved in year 2012. I tell you one thing, Mr. Rajoy: Publish that list, because if we do not do it as soon as we reach government, "Pedro Sánchez pronounced a couple of years ago in Congress of Deputies.
"It could be incorporated into law in future, but not retroactively," he reiterated on Friday Montero, who did show instead government's intention to amend General tax law to intensify fight against tax fraud and to include name of Administrators in publication of list of delinquents with Hacienda, as I had advanced last Wednesday.
In this sense, and being questioned by defense of PSOE in opposition to publish name of amnestied, Montero said that government does not leave any line in this sense, but simply publication of beneficiaries of Amnesty "cannot be done", except that re was currently some provision that required it, that re is not.Share in Facebook share on Twitter OtrosCerrarCompartir at LinkedinCompartir on GooglePlusCompartir on Pinterest
