Rajoy's legislative legacy resists

The absolute majority obtained by PP at polls on November 20, 2011 gave Mariano Rajoy a custom legislature to approve with comfort most defining laws of ideology of his formation. In that X legislature PP passed Law on Citizen security (known as gag law), Organic Law for Improvement of Educational quality (LOMCE), labor reform, abortion law reform (which withdrew) or change of functioning of Tribunal Constitutional. After failed XI Legislature, new Parliament marked goal of reversing legislative legacy of Rajoy, but despite lack of majority of PP, journey is full of obstacles.

The tactical movement made by citizens, in context of ir struggle with PP, to stop blocking some of se laws at congress table with extensions of deadlines for amendments (both add up to five of nine members) has reopened possibility of Disable legal architecture of most popular. However, process is not fast, and it also faces added problem that heterogeneity of chamber hinders agreements.

Unstuck initiatives to abrogate and reform gag law, Home Commission must now address a possible merger of two proposals (one socialist and or PNV) with debate and incorporation of amendments from various parties. And if consensus is reached, we must push for a law which, after its full vote, replaces current one. Although will of proponent parties is that this happens within legislature, outcome is in hands of timetable set by Commission and, above all, political events that may affect length of legislative period.

More feasible should be elimination of permanent prison reviewable following release of PNV initiative to reform Penal code in that regard. However, with PP and citizens engaged in electoral capitalizing punitive response to heat of cases such as Diana Quer (both parties have presented hardening initiatives, although party of Albert Rivera was contrary to this maxim Custodial sentence), permanent prison reviewable can survive remainder of legislature.

To abate LOMCE was one of first objectives of opposition after loss of absolute majority of PP. In April 2016 PSOE presented a proposal of law to curb educational reform, which went ahead with abstention of citizens and refusal in solitary Io of PP. The initiative asked to paralyze one of most controversial laws of Government of Rajoy, approved in 2013 only with votes of PP. The abstention of party of Rivera, which advocated its paralysis in pact signed with PSOE to invest Pedro Sánchez , pointed out that road was not expedited.

Citizens understood that it was necessary to move forward in an educational pact that would lead to anor law and avoid loophole. The government's willingness to negotiate a reform of law, diverted debate to Subcommittee on Education, whose trajectory has recently been truncated with abandonment of PSOE and united we can. Meanwhile, LOMCE is still alive.

Anor of initiatives that can now continue its process, with obstacles identified, is that of universal justice, presented by ERC. This rule was limited by government of José Luis Rodríguez Zapatero and eliminated by Mariano Rajoy in 2014. The recovery of ability to investigate and judge events occurring in or countries by Spanish judges has been a reiterated request from Public Prosecutor's Office, after reform of PP posed file of many causes.

Safe laws

But re are or laws of PP that remain safe, such as labor reform of 2012. In mid-December 2016, Congress approved a proposal not of law of PSOE to repeal it, but this type of initiatives have little travel. Since n, labour reform has only been a question in government control sessions. Citizens do not support ir abrogation (abstained in proposal with PDeCAT) and, because of ir incidence in budgets any initiative can be vetoed by government. Rajoy and Rivera have negotiated a number of points that Government has included in budget plan referred to Brussels with commitment to adopt a new Labour reform that shortcut problem of temporality. However, approval of budgets depends on or political variables and standard can be maintained.

As reforms introduced in Organic Law of Constitutional Court, adopted in autumn of 2015 by emergency route, which established prior constitutionality control for reforms of statutes of autonomy or direct disqualification of Those who violate resolutions of agency. Rules that persist even though Congress approved at end of 2016 PNV and PDeCAT initiatives to reverse m.

But without a doubt, most frustrating case for opposition is that of RTVE reform, adopted in June 2017 so that its leadership was elected by consensus in Parliament within three months. The chain of disagreements between different parties has practically resulted in a dead end. After a report of lawyers who now suggests reapply law of PP approved in 2012, Bureau of Congress and Senate has decided to return ball to parliamentary groups to make a proposal that is shaping complex. Meanwhile, a CEO elected by PP, José Antonio Sánchez, is still in charge.
