The Plenary session of Constitutional Court has given this Tuesday a step furr with disobedience to ir resolutions on 1-O. At request of State Advocacy -that is to say, Government-, magistrates have activated article which allows imposition of precautionary measures to disobedient against seven members and alternates of Sindicatura Electoral de Catalunya.
The measures to ensure obedience to TC, included in change in law that PP passed two years ago, look at it from imposition of high fines to suspension of functions and opening of a criminal investigation.
The resolution points out that it has been "warned failure of providence of September 7, 2017", which required seven to "refrain from proceeding to appointment of members of sindicaturas election of demarcation". Something, however, it has been produced.
For that reason, Court gives a period of 48 hours days to trustees, to explain what measures y are taking to comply with its resolutions. Those affected are Marc Marsal i Ferret, Jordi Matas i Dalmases, Marta Alsina i Conesa, Tania Verge i Mestre, Josep Pagés Masso, Josep Costa i Rossello and Eva Labarta i Ferrer.
The law states that if you received explanations again detected a breach partial or total of its resolutions can be applied four measures: fine of 3,000 to 30,000 euros; suspension from duties during necessary time of authorities and officials; request to Government to take necessary measures to enforce its resolutions; and communication to courts of alleged commission of crime of disobedience.
Finally, TC agrees to notify already appointed trustees of val d'aran, Barcelona, Tarragona and Girona to comply with suspension of rule that gave way to his appointment.
